유럽집행위원회, ‘나노물질 정의‘ 권고 수정 발표

유럽집행위원회(European Commission, 이하 위원회), ‘나노물질 정의‘ 관련 수정된 위원회 권고(Commision Recommendation)* 발표함(2022년 6월 10일).

위원회는, 수정된 나노물질 정의는 기존 위원회 권고 (2011/696/EU)* 를 대체하며, EU 내 모든 입법, 정책, 연구 영역에 반드시 적용하여 줄 것을 요청함.

‘나노물질 정의‘는 위원회 ‘권고(Recommendation)‘로 그 자체로서는 법적 구속력이 없으나, 정의에 포함된 핵심내용은 REACH, 살생물제품 규정(Biocidal Products Regulation, BPR) 및 의료기기 규정(Medical Devices Regulation, MDR) 등에 반영되어 있어 일부 규정 내에서는 법적 구속력이 있음.

위원회에 따르면, 신규 나노물질 정의는 기존 나노물질 식별 범위에 큰 영향을 미치지 않을 것이며, 수정된 권고에 따라 효율적인 입법 구현을 위해 노력할 예정.

수정된 권고 내 EC 나노물질 정의

‘나노물질‘은 자연적으로 발생하거나 의도적 혹은 부수적으로 제조된 물질로, 응집체 또는 집합체 형태로 존재하거나 식별 가능한 구성입자로 존재하는 고체입자이며, 입자 수 분포의 50 % 이상이 다음 조건 중 하나 이상을 만족한다(‘Nanomaterial’ means a natural, incidental or manufactured material consisting of solid particles that are present, either on their own or as identifiable constituent particles in aggregates or agglomerates, and where 50% or more of these particles in the number-based size distribution fulfil at least one of the following conditions):

1. 최소 1개 이상의 외형치수가 1 nm 내지 100 nm 크기 범위인 입자(one or more external dimensions of the particle are in the size range 1 nm to 100 nm);

2. 막대, 섬유 또는 튜브와 같은 긴 형태이며, 2개의 외형치수가 1 nm 보다 작고 다른 치수가 100 nm 보다 큰 입자(the particle has an elongated shape, such as a rod, fibre or tube, where two external dimensions are smaller than 1 nm and the other dimension is larger than 100 nm);

3. 접시 형태이며, 하나의 외형치수가 1 nm 보다 작고, 다른 하나의 치수가 100 nm 보다 큰 입자(the particle has a plate-like shape, where one external dimension is smaller than 1 nm and the other dimensions are larger than 100 nm).

입자 수 기반 크기 분포 결정에 있어서, 적어도 2개의 직각 외형치수가 100 μm보다 큰 입자는 고려할 필요가 없다(In the determination of the particle number-based size distribution, particles with at least two orthogonal external dimensions larger than 100 μm need not be considered).

단, 비체적 표면적이 6 m2/cm3 미만인 물질은 나노물질이 아니다(However, a material with a specific surface area by volume of < 6 m2/cm3 shall not be considered a nanomaterial).
